Child Custody: In Georgia, if there has been a provable material change in condition affecting the welfare of the child since the last custody award, a modification a child custody order is proper. Changes such as a party moving to a different state, a 15-year old’s election to live with the other parent, a parent’s incarceration, etc., may meet the standard for custody modification.
Child Support/Visitation: If two or more years have passed since the entry of the most recent order regarding custody or visitation, you can request a modification of those orders. Alternatively, if two years have not passed, but there has been a provable material change in condition affecting the welfare of the child since the last order, you can petition the court for a modification of your child support or visitation order.
